This Privacy Policy describes how ToFU ("ToFU", "we", "us") collects, uses and protects information when you use the ToFU app for macOS and iOS (the "App").

1. Who we are

ToFU is made by Agent33, and can be reached at tofu@agent33.com. This policy applies to the ToFU app on the Apple App Store (iOS) and Mac App Store (macOS).

2. Information we collect

To provide trademark and patent filing and case management, ToFU handles:

• Account information — your Apple ID, used to sign you in and sync your data via iCloud.
• IP application data — trademark and patent application details you enter, including applicant, agent and mark/invention information, which is submitted to the relevant intellectual property office (currently the New Zealand Intellectual Property Office, IPONZ) on your behalf.
• Subscription information — handled by Apple via In-App Purchase; ToFU does not receive or store your payment card details.
• Support correspondence — if you email us for help, we keep that correspondence to respond to you.

3. How your data is stored and synced

ToFU uses Apple's CloudKit to store your data and keep it synced between your Mac and iPhone under your own iCloud account. Your data is stored in your private iCloud database; ToFU does not maintain a separate central server holding your application data.

4. How we use your information

• To file and manage trademark and patent applications on your behalf with the relevant IP office (currently IPONZ).
• To sync your data securely between your own devices.
• To provide customer support when you contact us.
• To operate and maintain your subscription through the App Store.

We do not sell your information, and we do not use your IP application data for advertising.

5. Sharing with intellectual property offices

When you file or manage an application through ToFU, the relevant details are submitted directly to the applicable government IP office API (currently IPONZ) in order to carry out the filing you requested. As we add support for Australia, the European Union and the United States, the same principle will apply: data is shared only with the official IP office relevant to your filing.

6. Data retention

Your application data remains in your iCloud account for as long as you use ToFU. If you delete the app or your account data, your synced records are removed according to Apple's standard iCloud data handling.

7. Your choices

You can access, edit or delete your application data at any time within the App. You may also manage or cancel your subscription through your Apple ID account settings.

8. Children's privacy

ToFU is a professional tool intended for use by lawyers and IP professionals, and is not directed at children. We do not knowingly collect information from children.

9. Changes to this policy

We may update this policy from time to time. Material changes will be reflected by updating the date at the top of this page.
